Alimony deduction/income

At temp hearing I was awarded temp alimony, plus other monies for move etc. I was in court hallway while ex was in another room while lawyers worked out deal. Ex lawyer drew up this agreement and forwarded to a new lawyer I had hired. In this order things were not right and I brought this to attention of lawyer, but nothing ever was signed or taken care of. Ex continued with paying me alimony money but would not allow the other monies saying his lawyer said I would not get it until final decree. So, now comes final a year later and part of the monies was ordered in decree but other was not. My lawyer said to me...DO NOT file a joint return(fraud) and that the money he gave me was living expenses and not alimony being not signed by me or a Judge. I file return based on his advice. I have found out that ex CPA told him to claim it. So he does. I checked the instructions with IRS and it said that I have to have a "document" signed by both parties/Judge. I have no document. So can ex claim the deduction? Will the IRS send a letter to both? We filed Oct 16th for 06(ext). His returns 05, 06 are not right after I hired a forensic acct to get self employment income, assets, living expenses etc. Will the IRS audit him if he claimed a deduction that is not a deduction.
