If no one else claims her, then the IRS probably won't do anything about it.
Now, if they have two people claiming her, they are going to go with the custodial parent (which I believe I mentioned earlier). Will they throw him in jail? No, what they will do is have him refile without the exemption and may impose penalties and interest on him.
