What did you read differently about legal separations? The simple instruction in the "how to" booklet that accompanies tax return forms states it very simply. You could have been advised to file differently. And maybe, the IRS would "understand". But I doubt it.
The IRS can do WHATEVER they want to do. They write their own rules, they interpret their own rules, they enforce their own rules. They have more power than any other regulatory agency.
Good luck if you get audited.
