But how, based on your own argument, could someone gushing with hormonal urges and unable to see beyond their aroused genatalia be able to make such a reasoned decision. After all, they would be incapable of understanding what type of potential implied contract that creates. Apparently, you believe one implicit contract is more obvious than another?

Another one of your false analogies. The joint account is not comparable to running a business together, because there is an actual, real contract supplied by the bank. The potential victim, in this case, at least gets an opportunity to get full disclosure of what he is getting into before he has to do so in a divorce trial.
