You don't think your reason for not petitioning for custody yourself or not getting it, then choosing to move to another state MIGHT come up in court this time ?

Most of us here can understand the role of a non custodial mother just fine, thanks. What I don't understand is how you expect anyone here to answer your question about the likelyhood of you getting custody, when you have provided so few facts.

What kind of drugs has your ex been "abusing" ? Some people (thank you Tom Cruise) think people taking Prozac for depression is abuse. That would be considered differently by a judge than someone who shoots up heroin. Would your ex say that his ex is making this up because she is bitter ? Does she have a professional degree that gives her the knowledge base to diagnosis a problem with alcohol and drug abuse ? Are there any DUI's or police reports to back up the point that he is abusing ? How old is your child ? Has your child said anything about daddy acting weird ? Has your ex acted strangely when you see him to have visitation with your child ? If his home situation is that bad, did his ex or anyone call Child Protective Services ?

The more info you give, the better advice people here can give.
