The law does not consider placing your arm just behind on the bench you are sitting on to be a physical assault. No reasonable person would classify it as such. If someone walking on the bench bumps into your arm and falls, then they are either not coodinated or not paying attention.

I am not saying that I don't believe that you have suffered abuse from your stbx. I am saying when you go to court you need to be careful to bring up only true and provable incidents of abuse to the judge. Overreacting to AH's comment shows all of us that your ability to define actual cases of abuse is seriously flawed.

In your example from the op here, I believe that he probably did kick you on purpose. Unfortunately, if you don't have a witness, you can't prove anything, so you are better off not using this as an example to the judge. Printouts of the offending emails are proof. A neighbor who can testify that your stbx drove by your house at 10:30 pm 12/16/08, violating the RO is proof.
