After going through things with the lawyer, we had brainstormed the blindsides, I came to the understanding that mediation is not manditory. I learned that mediation talks can stop at any time, or if the final proposal is not good, you can simply go to trial.
That's all good.
What are the chances a judge in trial would rule that X keep the big house and I get everything else if he can prove he can't afford it?
I'm thinking that's not fair to X. Even tho this is exactly how he said he wanted things previously. His job is not going well and he has had negative income for the past two months.
Won't a judge order the sale of the big home and division of the liquid assets 50-50?
That would suck for me only in that I'd have the next few years of dealing w/X (waiting for the house to sell) instead of one clean cut next week.
