Tou are the CP and the CO states that you are to sign form 8832 by Jan 15th. It doesn't matter that he hasn't asked for it, you need to have it signed. Personally I would send it to him by certified mail.

Paraphrasing the IRS: the IRS will no longer read over CO to see who has the right to claim the child for tax puroses, if there is a dispute than the IRS will side with the CP.

That being said, you have a CO that states you are to sign Form 8832 by Jan 15. You need follow the CO and sign the form. IF you claim the child and he also claims the child than your ex could take you back to court for contempt and most likely you will lose.

What you CAN do, file in court to change that you should be claiming the child for tax purposes. You can cite whatever reason you want, like you said that he doesn't take the child overnights much. See what the court says. They may agree with you and change the CO or they may not. But until you get the CO changed, follow it.

BTW, the courts really don't care if the NCP don't take their parenting time.
