I can't see the kids keeping the benefits if they're not his and you're not married anymore, but I may be wrong on that one. Since he's elderly and disabled, and you're 37 and not disabled, I would suggest you start looking for another place to live with your kids and find employment if you don't already have it.

Depending on the state, whatever funds are leftover after you subtract the debts incurred during the marriage from the assets accrued during the marriage is usually split 50/50. Again - depending on the state.

You should get to an atty or two for a consultation to find out how your situation would play out in court.
