Unless you're physically in the room with them and know for a FACT that they're sleeping in the same bed, the only thing you know is that he's stayed at her house overnight. You don't know where in the house he may be sleeping. You don't know if this is a roommate or a boyfriend. You really don't know much of anything. Period.

What options are you seeking? There are only three grounds for divorce in Virginia -- abandonment, adultery and no fault, with most of the cases falling into the no fault category. In this day and age, it's sad, but adultery really doesn't mean anything or garner you additional rewards for knowing about it.

More info would help -- how long have you been married? Kids? Joint property holdings? Military/civilian?

If you've been apart three months and this has been going on for two months? In all honesty, you don't have a case for adultery, although you're not divorced yet, you're also not living in the same residence. You're separated. There is the understanding that parties can act as if unmarried during a period of separation.
