About a month and a half ago my stbnx wife said she was going to be visiting her family on the other side of the state for a few days, we got in an argument over when her and my four year old daughter were returning home; I smelt something fishy and said to my then wife "I'm so upset I feel like breaking things the next day she came home without my daughter in a convoy of her friends and family packing up the things in the house that she thought I might "destroy" I did not and have never destroyed any property of mine or hers in any way.

I went and saw an attorney the next day, and found out that my stbx had filed for divorce a few days earlier; in the county that we live in. a few days later I was served with divorce papers stating that she wanted to relocate to the other side of the state and that I needed supervised visitation.

over the past month and a half I have retained an attorney and have a temporary custody hearing scheduled for next week. I have had very little contact with my daughter except for when her mother and sister brought her back home for her birthday, during that time my stbx and I reconciled and she admitted to me that the only reason that she had requested to supervised visitation was to use as leverage;under the advice of her mother, and lawyer, and would have dropped it if I did not contest her moving and having full custody. (blackmail). A few days later she called off the reconciliation and said she wanted to continue with the divorce. with the exception of those few days she has remained on the other side of the state, and has denied any me any access of my child unless her terms (being with my daughter in a single room at her parents house) have been met.

after the reconcilation had fallen apart I played nice and got my wife to admit on an audio recording that she would drop the supervision and allegations of mental abuse if I let her move. She has since learned of this recording.

my lawyer has advised me under no circumatances am I to accept her "terms" and allow her to move away, or to acknowledge the supervision of my daughter.

I went across the state to see my daughter and make one last effort to keep this out of the courts. My wife wanted to play lawyer ball and I kind of got the feeling that I was being recorded, and asked my daughter "has dad ever hurt you or made you cry?" this made my spouse angry. Then the police got involved both I and her parents called them. the jerk cop said that even though she's breaking the civil laws by taking the child out of jurisdiction and interfering with my visitation there was nothing that he could do. I said since there are no papers signed by a judge determining custody I have just as much rights to my daughter as she does. He said "no you don't she has physical custody (no she doesn't), and if I tried to take my daughter that I would be arrested.

HELP!!!!
