When I lived in Louisiana I felt they had a somewhat fair system. The way it went was something like this…

Let’s say John Dow and Jane Dow file for divorce and Jane is awarded custody and have one child. The court orders CS to be paid to Jane Dow. They earn a combined salary of 100K per year. (Just using a round number because it’s easier to work with)

They set the child support at a specific amount. (For arguments sake is 20%)

20% of 100K = 20K per year in CS

John Dow earns 60% of that salary and Jane Dow earns 40%
John is responsible for 60% of the 20K and Jane is responsible for the remaining 40%

That sets his CS at 12K per year that’s 1000 bucks a month

The good part of this it keeps things fair because if the percentages were reversed and Jane earned 70% of the total income his CS would go down

Here in the sate of Texas I have found out that that is of little conscience.

It is a flat rate of 20% of the non custodial parents’ income regardless of how much Jane earns.

So if Jane gets a job a year from now earning 200k per year and John is still earning 60k he still pays this set 20% to Jane and she gets this Tax free mind you.

I personally think they need to set some federal laws regarding matters such as this.
