As much as some NCP supporters want to feel sorry for the ex who is trying to make regular payments, he needed to file for a modification of child support as soon as he lost his job! He is legally obligated to pay current support and the arrearage so long as he doesn't file.

I am the CP and having the same problem with my ex. He also stuck me footing the health insurance premiums for our daughter and 100% of the uninsured medical expenses after quitting his job over a year ago. (While he carried insurance, I was fine with paying co-pays and small expenses not covered by insurance and never asked for half for reimbursement.)

I'm not expecting a massive arrearage to be paid off now that he is underemployed, but I do expect more than $90/month and up to 50% of his disposable income as the law allows. That amount is a far cry from what should come for our daughter before he supports his girlfriend (who also works) and her child (from a different relationship). The NCP has no one to blame but himself for failing to file for modification.

It's up to your wife, however, to document payments (look back at deposits from her checking account if needed), medical bills (should be able to looked up claims through your insurance provider, if you have insurance), etc.

It's up to BOTH parents to support their children, and if that means dropping a phone line or selling off a computer to meet their basic needs then that's what needs to be done.

My attorney told me that what usually happens is that the NCP winds up paying off the arrearage after the child is emancipated. It won't just go away.
