If he does it, and it is legally changed, there is no fraud. If he doesn't, and it is not changed, how would you ever know what she is getting.
Right now she has her child listed as a dependant, that is for benenfits, etc. Her Husband is the reason she gets full BAH. They will not give you two BAHs. The day she is divorced, she drops to BAH diff because of a CS/custody order. The order is legally changed, the BAH is legally changed. If she were to live on th economy, she couls be entitled to BAH with no dependants, but that depends on the Chain of Command.
If your DH cooperates with her, it is not fraud, if he doesn't, oh well, what she turns in as far as custody for getting BAH, is up to her.
