I would recommend that you get exactly what extracurriculars means, relative to pro-rata share division. For example, if it is a school thing, that is required, or reasonable.. then split. For other extra-curriculars like dance lessons, guitar lessons (sorry Cassie, it's the thing that popped in my head cuz you were talkin' about 'em recently!!), things NOT specifically associated with school, then define them as up to the discretion of the parent who enrolls the child in the activity and that parent bears sole responsibility for and and all fees and/or other costs, associated with said activity. If child is on the school Debate Team and there is a trip that costs $100, you would split that per pro-rata shares. That, personally, is how I would do it. I'd be VERY specific.
If you need language re: the waiver of alimony as per Atlas' suggestion, I can give you language out of my Stipulation of Settlement that should work nicely for you.
My "belief" is.. and again, take it for what it is worth.. I do not KNOW your specific court district; however, my GUESS is? That it is more likely to follow the behavior of the LI courts, than it is to follow the upstate/western courts.
Make sure you have your CSSA worksheet properly filled out, make sure you have the CSE form filled out, even if it is that you guys are WAIVING use of Child Support Enforcement. You must have the form.
Oh, if you DO agree to cap income? Make sure you clearly STATE that you are. Usage of the cap is still considered a 'deviation' from the CSSA and must be documented as such in any Settlement Agreement (Stipulation of Settlement) or Child Support Order. Failure to properly document a deviation will get your papers kicked back here.
If you care about move-aways, the standard restriction is 25 miles. People say 50, but any lawyer I've spoken to in NY has used 25.
