Yes - I have the agreement we both signed stating that we would apply the child support percentages to unemployment compensation.
I was let go in 2004 from a position I took in 1998 pre divorce and support decree. The cs is based upon the 1998 wage I was making. Whenever I got an increase, I would upwardly adjust the support amount, showing my ex my pay stub. The cs went from the court ordered amount in 1998, 1999, and was modified each year after that whenever I got an increase. I was up to $1,000 monthly in 2004.
When I was let go in 2004, we modified it by mutual agreement to be 480 for the 4 wk months and 600 for the 5 week months. Every opp I had to pay more, I would. It was brought to my attention when she first started claiming arrears that I should do whatever I could to at least pay the last court ordered amount, so I was sometimes paying more than 40% of what I made in a month - even though it was less than the 1998 court order. But suffice to say, yes, I have an agreement we both signed.
And the court ordered support is still not modified.
I have been paying the court ordered amount of $600 for the last few years and since the summer have been paying more as a result of my employment.
I hope this helps to straighten out the numbers. I appreciate your time with this.
I hope I am not coming across as if I'm attempting to shyster out of support. It just seems whatever agreement we make above and beyond support, it's never good enough.
I do everything I can to support my kids, but somethig somewhere has got to be fair and there's got to be a way to do it without me having to "go to court to seek relief" as the family courrt magistrate has advised me.
If we do go to court, I will have no legal representation as I cannot afford it. The ex has a legal benefit so will undoubtedly have legal representation - guess this puts me at a disadvantage as well.
