That's simply not true. Find your state's child support guidelines and show them to her. Unless you agreed to it at the time of divorce, you don't have to pay CS AND college expenses.[/quote]
------------->> NOT necessarily true.. SIGHHHHH.. STOP talking about CS rules in a state you know NOTHING about!!! If CS is ordered to "x" age AND education is ordered YES, you pay BOTH. You MAY get a credit of a PORTION of the college expenses credited TO child support; however, unless specifically written up that way.. that CS is NEGATED by paying college? THat ain't the way it works here. Period.
Furthermore, JUST because you do not have education ordered AT the time of divorce? Does NOT preclude EITHER party from pursuing college costs LATER ON, IF you have had your order or Stipulation written up properly.
For example, divorcing when DD was age ONE, it made ZERO sense to make a determination of who would pay what.. 17 years LATER. THerefore, our STipulation specifically states that college is NOT addressed; however, it does NOT preclue either party from pursuing it later.. POST-DIVORCE.
Stick to Florida and Colorado, you are TOTALLY ignorant of NY law and even AFTER you've been educated on it.. repeatedly.
