Yes. :( Temporary orders tend to be permanent. Judges do not like to change them.

But - you have at least one other option. Once the divorce is final, there are generally two things that can be changed - custody and child support. Unless one party can prove that the other hid financial assets prior to the divorce, you cannot change/revisit the financial division.

Here is what you need to think about. Get the financial division closed and get the final order in place. Then, take the kids as much as she will give them to you. Keep them at your house for weeks if you can. Give them to her every other weekend. Keep detailed notes (a journal), receipts, etc - anything that shows over a period of time that YOU have been the overwehlming custodial parent. In about a year, take her back for a "modification". Have the Texas every-other weekend and holiday schedule put in place and child support paid to you. But you need to plan for this scenario by keeping a detailed calendar of every minute the children are with you. The children will be a litlte older at that point and the older they get the more power their word has with the judge. 12 is probably a little young, but I know people who have had their 14 and 15 year olds make thier decision and the judge accepted it outright.
