Would a lawyer be a waste of time and money? (AL.)

It's a long story (when is it not a long story?). I'll summarise it to make it easier to read.
I was married 4 years ago. I'm 26, my wife is, um, i guess 22 now? or 21? Maybe that was one of the problems.
She cheated on me, I took her back. She said she wanted a divorce, I talked her out of it. She said we should "take a break". I was making good money, but we were living with her mom since we had bad credit and she'd gotton both of us arrested for theft. (she got youthful offender status, she was the thief. I was guilty by association, had to do community service and its on my record. Anyway-
See there, I almost started ranting again. Back on topic. I agreed that neither of us were happy, when I got my check I would give her half (for the last time) and move out. The next day, she kicked me out on my a**. Long story short, lost the good job, living with my mom now in a diff county but same state. Then she filed my tax return online, and got my money, and never saw any of it.
Is there any chance of getting my money from my tax return back? The thing that makes me mad is it would have been enough for a divorce, or a few file-your-own divorces. Now I'm working fast food, and constantly broke. That is the only reason I'd consider getting a lawyer. I know she's living with a guy I was friends with a year or two ago, (before she cheated on me with him)
I know normally I couldn't get the money, but we had a verbal contract I recorded on my cell phone. (don't know if it's admissable or infringement of privacy though)
Man, that's a lot of words without any actual questions... Here are the questions. 1. Any chance of me getting that money? 2. Tax season is here, and I'm worried she'll do it again, even though I filled out change of addy forms. 3. Should I get a lawyer? 4. Any idea of an organization that might help me get my divorce? (I make less than $300 a month and live with my mom, who is retired. Got approved for food stamps.
