401k division in Tx

My wife and I are going to be getting a divorce. It is an amicable uncontested divorce. I cant touch my 401k as long as I'm employed with my current company. I've been told that in Texas I can sign the entire amount over to her and she can roll it over into an IRA then cash it out without paying the 10% penalty. Therefore giving me my half when it's done. Is this true?
