Well in this case the birthday rule would have no bearing for 2 reasons. One the father is CO's to provide the insurance. The CO trumps the birthday rule so he would be the primary. Second it's the SF who is carrying the insurace not the mother so any insurance that the SF provides wouldn't be primary. The parents would..

Yes, they could get in trouble. Best case scenerio ius that the SF's insurance could refuse to cover her further, worst case they could be held for fraud. They are not smart not to use the other insurance anyway as the SF's would cover after the primary and their bills out of pocket bills would be less. My suggestion is that they come forward to the insurance company tell them there IS another insurance and they didn't realize it should have been the primary. Insurance can be confusing so I'm sure the insurance company would let it go and continue as usual.
