No, a simple video tape is probably not enough. However, if she is unstable and you move close by so that you can get standard parenting time (EOW), it may cause her to interfere with your relationship. When this interference occurs (such as denying you parenting time), you have grounds for a change in custody. If you could entice her into an argument and a physical assault on you, you might have additional grounds to request a change in custody. People who are unstable cannot handle pressure. I would look for ways to increase the pressure. For example, if she doesn't provide you information about visits to the Dr, I would send certified letters requesting the reason for the visit, the diagnosis, prognosis and course of treatment. Everytime they have to break their schedule to go to the post office to retrieve such a letter, the stress level goes up a little more.
Bottom line... most people think there ex is unstable. In fact, I don't understand why the people who spend so much time with my ex can't see the things I do.
You will need evidence that she is neglecting your child, has anger management issues or is willing to interfere with your relationship and will totally disregard the needs of your child because she is incapable, unwilling or just so bitter at you she can't.
-------------------- The right to have a relationship with your child is not the same as having parental rights.
