The Air Force is not very vague, they're actually very specific. AFI 36-2906 clearly dictates that he is responsible for using the extra income (about 300.00/month) he receives for dependents to support us. If he is not using that money to do that, he is required to prove that he is, or it will be garnished from his check.
The state of Idaho makes provisions for spouses in my exact situation, and will provide an order of temporary support until the divorce is finished, without regard to the length of marriage as temporary spousal support during the marriage is not in the same category as alimony, which DOES consider the length of the marriage for determination of alimony.
His obligation to pay the utilities and rent is a civil obligation independent of his requirement to support his dependents as the military also requires him to honor all civil contracts he has entered into. Whether he is with me or not he'd have to pay the bills here. So he cannot say that he is supporting us by paying the utilities for the house, per his 1st Sgt. who ordered him to give me money a few weeks ago to which he refused and finally had to be threatened into compliance.
USAF is not telling me to get a court order, they are simply slow in enforcing the above mentioned rule as they're trying to give my husband a chance to do it on his own to help his career. If he has to be garnished for refusal to comply with a military order, it's kind of a big deal. I could've gone to the IG which would've caused quite a bit of a bureacratic mess for my husband's command and my husband. But because I honestly love and care for him and have no intentions to hurt him, I'm going through civilian court.
The scary part is that the man I married has no problem whatsoever with putting myself and my children in the street with absolutely nothing and is doing everything he can to try to make that happen, and it's up to me alone, with no legal help whatsoever, to try to stop it.
