Red, can you clarify? I've zero experience with mililtary BAH, but I don't get this. I realize her stbx is AF & you're talking Army, but is the formula the Army uses different than 2148-1665=483x24 ? I'm trying to figure out how the Army would say 51,552 is owed for support.
Not trying to argue your points, just curious on this part.
BAH is awarded by the same two things in all the services, it is by rank, and zip code. The AF rule is that the service member has to pay "adequate" support to a seperated spouse. That is a made up amount, it can be whatever someone deems it is. The difference between single and with depenedents is just something someone made up, sort of like how they feel that day. It exists on paper as to how someone is paid BAH, but it is not given as a standard anywhere. The Army does if differently, the spouse will be given an amount equal to the BAH with Dep rate. There is no wiggle room, except for a court order
In both cases the military will take a court order as the amount, they have to honor it. In this case, the court was delayed, so no order could be issued, so it defaulted back to the whatever someone in the AF said was adequate. If it had been the Army, then it would have defaulted back to the BAH with dep rate.
