Possible Fraud

During DH's recent CS modification it was discovered that ex had been collecting money over a 30 month period for day care expenses, but boys had not been in day care. DH's attorney is saying he can file through Family Law courts, but 50% chance of getting the money back. Can this be filed through criminal courts as fraud instead? Close to $8,000 involved.

She also collected $6,000 in insurance payments during this same period of time, but never had the children covered by insurance.

State is Florida.
