The answer depends on the resulting Order.

Spousal maintenance can be bought out, meaning forever waived by the payment of a lump sum up front in the form of liquid assets or property that may generate income or be sold.

Spousal maintenance awards may be temporay, permanent, modifiable or non-modifiable. If non-modifiable, the amount does not change regardless of whether either party has an increase or decrease of income. If the recipient wins the lottery, it is not modifiable. If the payer loses his/her job, it is also not modifiable. As a result, such an agreement carries with it calculated risks.

If left up to a court without an agreement, spousal maintenance awards are always modifiable based on a substantial change in financial circumstances for either party. In such an instance, you may be require to report changes in income.
