Actually no, it's not a 'given'. And no I didn't see where you mentioned 70% of the time spent with the child. Sometimes no parent 'should' receive support, it depends on many dynamics of the situation so just having the child more doesn't make child support a given.
You have no idea who I am or what my situation is, so please don't imply I'd advocate a mother going for support over a father simply because of the title. FYI, I have two stepchildren, who spend about 60% of the time with me. My husband has faithfully paid $1250 a month in child support for the past 10+ years and faithfully paid ALL extras for sports. For the past 6+ years we've had a 50/50 schedule off paper and still paid the same $1250 every month. SO PLEASE don't assume I'm some bio-dad hating woman who's only after child support for the Mom. I'm after helping ANYONE who is asking.
If you're bringing in little to no income, then you should be making changes to that immediately so you can help your child get the things she needs and wants. If you want custody, you will have to make some changes, some preparations, you will need a job, a stable home, you need to document the extra time you're with her and why you're with her this extra time. Then you take all of that to an attorney, who often gives free consults, and you see what kind of case you have.
Frankly, you already know what will happen. Your ex will decide NOT to send her to you and instead send her to daycare, and the 50/50 custody will stay, and you will lose that extra time. All for about $100 a month. $1200 a year. You have to decide if it's worth it.
