He did not get laid off. He picked a fight with his boss and walked out. He has not made any efforts to find new employment at all. I do not have a verifiable job opportunity as I am the only stable one for our children to live with, and I would have to hire a qualified child care provider to work with my son's special needs situation which is very expensive. My wages alone would be paying for child care and my child would be without the one person who knows how to handle him- me. My ex routinely has to call me to get advice on how to deal with the children when he has them. They are "too much for him to deal with" and he "has had all he can take from them" after only one day of having them. Yet I continue to do my part and send them to him for his time with them regardless of the fact that I know he is unable to make the right decisions for them. I just found out from his older brother that he has lied to me about his charges that he is on probation for and there are more than I was aware of. He is also driving around with a revoked license, something he did not tell me. He has been driving my children around with a revoked license without my knowledge. Why exactly should I stay here and continue to put up with that kind of behavior and constant lies? If I did move back home my parents would be there to help with my children after school while I work full time and go to school. They are retired and want nothing more than to have more time with their grand kids. They are begging me to come to the support they have to offer.
My question was not what do I do, but would a judge really allow him to take custody from me just because he refuses to pay child support when he has so many strikes against him and I have better support elsewhere?
