First of all I am certainly surprised that the court just allows one to CALL and that changes- ends or resumes an order. Having been on BOTH sides of a CO (collecting and paying CS) with my H's child- I just can't get over that. What a mess of paperwork this would cause.

#1- You stated what your H's X kept during the time she was suppose to be giving your H the money back. DOES NOT MATTER. The order was in FULL FORCE. The only time the order changes is when you actually modify the order. Your H was able to modify it (by terminating it) over the phone...so anything she received AFTER the order was stopped through the court would then (and only then) be considered an overage and reimbursed back to your H.

#2--I am REALLY wondering if your H received the CO TERMINATING his CS??? If not, regardless of what the court secretary is telling you I don't know that it was REALLY terminated? You should have received a new order stating that CS was terminated, dated and signed by the judge.

If that is NOT the case, then your H still owes it regardless of whether the X RESUMES it.

Of course if it was truly terminated then YES someone has to go to the courts to get it resumed...which again is impossible since it was terminated. If something is terminated it cannot be resumed- the case is CLOSED- you have to get the paperwork to start the process of receiving CS.

If you haven't received an order terminating CS then I would call the court and ask for a COPY of the terminated order. If not, I would bet your H is still on the hook for CS, and in arrearage.
