The April 19, 2010 Supreme Court decision in Webb v. Sowell, 387 S.C. 328, 692 S.E.2d 543 (2010), ruled that inconsistently requiring parents to pay college expenses as part of child support is unconstitutional.

The prior law allowed family courts to order some parents to be subject to college support obligations. This stemmed from an old case by South Carolina’s Supreme Court in Risinger v. Risinger, 273 S.C. 36, 253 S.E.2d 652 (1979)
