I don't know if it matters what state you're in.
I'm in CA, and I've been told drug use isn't much of an issue unless there has been substantative records of arrest because of it. Meaning that although we've had financial problems in the past due to drug purchasing (they don't tend to issue 'receipts', ya know), and although the BUMD has smoked pot in front of the children in the past, and although I regularly find a 'stash' in the house (most recently found rolling papers, pot residue, and a half-smoked joint under the children's bathroom sink two months ago), it doesn't matter much with regards to custody. I guess if they admitted it, or voluntarily submitted to drug testing it might be different. Otherwise, I think it's just filed as hearsay. It's illegal, but it's only illegal WHILE they are doing it, or if they are arrested while in possession. For example, there's no way to prove the pot under the sink wasn't mine, my 8 or 6 year olds.
I could be wrong, but that's the way it's been explained to me.
