First, what state has the court order, is it Texas or Michigan?

Honestly, you had no income at the time. Now you have income. The reasonable thing to do would be recalculate based on both current incomes and include day care if it's allotted by the state. I think it would be unreasonable to say that you deserve the money you are currently getting because you didn't include daycare before.

Now he will have to petition for the change, whatever state has the court order will govern the court order. So if it's Michigan, he would review, recalculate, include daycare and come to a new amount.
