I went to the courthouse yesterday and got a certified copy of our original divorce/custody decree.

---> That's all well and good, but the original Decree has been modified since then and you will need copies of the most recent court order.

My ex was very abusive. I know that is often claimed in cases like this but he was. 2 of the people that actually witnessed him beating me now live in the next town over from him. Would it be beneficial for me to call them as witnesses to prove he is unfit?

---> No...because if he wasn't 'unfit' when when turned custody over to him in '09, why would he be 'unfit' now?

---> Right now...the ONLY person 'unfit' is your husband since he is facing DV charges against your son...which is WHY your ex-husband if filing for custody of both of ya'll's kids.

---> Speaking of which...having some experience with the way the judicial system works...I'm having a hard time understanding why he was in jail for 32 days after his arrest. He would have had to been arraigned (where the charges are read) within 24 to 48 hours and then he would have been either released on his own or posted bond. If you don't already have an attorney...better get one.
