I don't think it's just a NY thing. Your hubby can't stop his x from moving, only from taking his daughter along, so in essence he would have to request custody to keep his daughter close by.

In WI it's in my CO that if either my x or I moves we relinquish custody to the other (also 50/50).

But to anwer your question, yes she would be ordered to pay CS to your H if she moves and he has custody.
