Loitering in a gated community of which you are a non-resident after dark shouldn't arouse suspicion? ---->Suspicion? yes. Attempts to apprehend by an unknown male? No.
Would it have been 'okay' if Martin had been a year older and therefore NOT a 'minor'?

One can argue that Martin should not have been loitering in a gated community that he was not a resident of.

---> I could not disagree more. He was staying there, overnight, with his father at the invitation of a resident. Gated community is not = no one but residents can be there. Its no one but residents and their guests. It is not reasonable to assume you will know every person you see. Most, yes. In this case, he was a black teenage male, so the police were called, because of the perception. I don't like it, but I guess I understand. I watch enough First 48 to know why.

One can argue that Zimmerman should not have left his vehicle after spotting a 'suspicious' person, that he should have just waited for the police. One can also argue that Zimmerman should have discontinued following Martin when advised by the 911 dispatcher that he didn't have to.

One can argue that Martin should have identified himself. One can argue that Martin, instead of calling his girlfriend, should have called the police or his parents.
----> I disagree. No way would I stop and identify myself to some random dude following me around in a friends neighborhood. And as a teenage kid I am not surprised he phoned a friend.

One can also argue that Martin shouldn't have confronted the person who was following him and/or attacked him.
----->That is still in dispute whether that happened, but in light of what happened it would be foolish to say he SHOULD have done that. Whether that failure creates justifiable homicide or not - well I am leaning towards NOT. Maybe not murder, but something.

As for the 2nd degree charges - I assume they are aiming high as their starting point for negotiating a plea. That is how we do it in this country. They obviously want to avoid court and the circus a trial would become.

And if being dead is a free pass for behavior? I would wish I had the opportunity to pay up, because that is a sucktastic pass.
