It is not reasonable to assume you will know every person you see.

In this case, he was a black teenage male, so the police were called, because of the perception.

---> What 'perception' would that be? Black? Teenager? Male? Hoodie? Sagging pants?

I don't like it, but I guess I understand. I watch enough First 48 to know why.

No way would I stop and identify myself to some random dude following me around in a friends neighborhood.

That is still in dispute whether that happened.....

.....but in light of what happened it would be foolish to say he SHOULD have done that.

Whether that failure creates justifiable homicide or not - well I am leaning towards NOT.

---> If I'm carrying a gun and an unsub attacks me...odds are pretty good if I can gain access to my weapon that I'm going to shoot him. Probably even kill him...depending on whether I am aiming to kill or have a concussion from having my head based into the sidewalk and my aim was off.

As for the 2nd degree charges - I assume they are aiming high as their starting point for negotiating a plea. That is how we do it in this country.

---> As for your assumption...yes and no; you cannot be charged beyond the extent of your crime. As an example...I get busted with two joints in my purse, I can be charged with a non-criminal violation, but I can't be charged with felony possession with intent to distribute. But let's say that I've been busted with just a smidgen over an ounce of weed...that's a Class B Felony/up to 10 years and $250,000 in fines. Since I am technically OVER an ounce, the State has a good case, but they also know that since it's just a smidgen, it'll mostly get knocked down by jury to a Class A Misdemeanor...so that is what they offer me.

---> Additionally...plea bargains are only good if they are a bargain. If I get busted with two joints and the State thinks to scare me with a Class B Felony charge and offers me a Class A Misdemeanor...I'd tell them to kiss my ass and 'see ya in court'.

---> Unless the State has a 'smoking gun' (pardon the pun) that we don't know about...I think they are making a HUGE mistake with a 2nd Degree Murder charge. I haven't read anything that even suggests that Zimmerman was depraved enough to follow Martin with the intent to kill him....which is what they HAVE to prove to get a 2nd Degree Murder conviction. I think that Zimmerman was stupid, I think that he was reckless (negligent) and that he needs to be held accountable. But Murder...NO.
