Im going through the same situation. I have been the mother and the father of my children from the time they were born. My husband and I separated, not legally, but we did have separations papers written up and they were signed. I relocated to the State of New Mexico and he relocated to Arizona. Before leaving Virginia I had him sign and agreement for me to bring my kids with me to New Mexico and start my life over with them, It was signed and notarized.
When he moved to Arizona he would come pick them up and take them for the weekend and I would pick them up on Sundays. Three weeks ago I went to go pick up my kids on Sunday and my daughter was no where to be found ( my son was there), he would not give me back my daughter or tell me where she was. I called the AZ cops and they did squat! He told me that he would bring her back that following Friday and instead I get a call from a Lawyer stating that he wants to file a restraining order on me and that he wants custody of my daughter.
First of all, I have done everthing for my children and he is trying to accuse me of all these false accusations, turning everything that he has ever done, onto saying it was me!!!! The law is in any State that a child has to be a resident of that state for 6 months before and custody issues, my daughter has not even been there for a month. I have not lived in NM for six months (which is the requirement in this state to be a resident)
I can't get help from anyone in any of the three STATES. The only reason he has taken my daughter is that I will not return with him for any reason.
He is coaching my daughter into hating me and not wanting to see me or talk to me by phone (she is 4). I have been denied to see her and not able to talk to her because of his cruel intentions. I have tried to get legal advice and no one is willing to help me because Im not a resident of the State od New Mexico (1 1/2 months to go) and I was told to get help in Virginia because that was the last residency of my daughter and they won't help me either.
I don't want to lose my daughter because of his false accustations when he damn well knows I have always done EVERYTHING for my children and he has done SQUAT!
