As some of you may remember, my STBX filed a motion to dismiss my divorce petition based on lack of jurisdiction over him. I live in WI, he lives in OH.
Well, my lawyer brought in several cases before the judge showing that since I'd lived here for at least 6 months, i work here, my daughter goes to school here, she's in daycare here, that I had grounds for divorce in WI. His lawyer then spouted off about how if I get divorced in WI, Ohio wouldn't recognize it. Has anyone heard of this before?
The judge responded by saying that so STBX could stay in OH his whole life, and then his wife would never be able to divorce him? I don't think he was buying it.
So, the results were that we can go ahead with the divorce and child custody. CSE is going to handle child support and use the interstate code to try to get that. There's no property to divide up and I already paid off all the debts myself, so I wasn't too worried that they can't go ahead with that part of the divorce.
They said the final hearing date for August 1st, so hopefully everything will go smoothly until then!
