Don't want to gamble on house
      05/19/05 02:20 PM

The wife and I are getting a divorce in Nevada. We are doing it ourselves without a lawyer we are talking and trying to remain friends. We own are home free and clear with no loans, but I have just found out that my wife has a gambled over 85k and put it all on my credit cards. The house is in both are names. We don't want to sell the home because the money we would get minus the debt would not be enough to buy again in the area my son now goes to school. She is getting a 1st mortage on the home in her name to pay off the debt and a little extra for herself. We would then like to sign a notarizes contract that would state the amount of the 1st mortage I would be resonable for at the selling of the house( mortage is an interest only loan)no later the my son's 18th brithday, and rest would be her responsibility. This way my son and wife could live in house and not displace him from his school. She would like to pay on loan and tax's on home till the house is sold. What I need to know is would she be able to get other loans that I may be held responsible for? Dose the house have to be in a trust to protect myself from late loan payments and tax's? Is it even possible for her to get a loan in her name with both are names on house deed? Is this at all posssible with out paying lots of money to lawyers?...Teal
