Can grandparents get custody?

My daughter is divorced from her first husband and has a 7 year old by him and "joint custody" although the child resides with her and her ex spends very little of alloted time with him. No problem there. She is currently married with two toddlers and problems have develped. She is in treatment for prescription drug addiction and I have found out that she gave over the counter meds to all three children so they would "sleep" when she wanted to! Her spouse "left" her and the children for three weeks supposedly hoping it would bring her around, but never let us know anything until she was admitted. Then, he called us for help and wants us to come get the children. Now, I am angry at them both! Neither is a responsible parent!
Her for her addiction and treatment of her children, him for deserting his babies for three weeks in her care!
The problem is that I live in one state and they live in abother, and her son's father lives in still another state! I don't know what state to file in! I will be getting the toddlers in a few days (with power of attorney) to keep indefinetly. Do I have sufficient reasons to seek permanent custody? HELP!
