Help!! Husband Took Tax Refund!! (NY)

Hi! I am from NY and have not filed for divorce yet. I plan on doing it as soon as possible!
My h did not file taxes for '03, '04, and '05 for no good reason. So I finally had him give me the papers and they were filed. The total returns came to almost $30,000.
His ex got $13,000 for back CS. We got $16,000+. Couldn't deposit the checks in his bank account (I don't have one) because my name is not on the account and he refuses to put it on since he says I am "not allowed" to have access to "his" $$ since he is the only one that works.
So, we go to a check cashing place and we both had to show many forms of ID. He takes the cash and refuses to give it to me. He goes thru $$ unbelievably fast! I tell him that I just want to put it away until we decide what we are doing with it, he says it is his return since it is from his income and he will never put my name on the returns again since it shouldn't have been there in the 1st place! lol
Now am I entitled to 1/2 of the total or 1/2 of what he took? The money was jointly ours so why should I have to pay his CS when he just refused to for a year and a half? I think I should get 1/2 of the total, but don't know if that is the law in NY.
This was the last straw!!
It hasn't been deposited in his bank account b/c I can check i over the phone, so there must be a second account or he still has the cash!
I also need to file since he stopped paying the mortgage for 6 mo for no reason and I found this out by getting served foreclosure papers! He is supposed to pay them something each month, but if he doesn't, they will accelerate the claim! We have 4 children together (9, 8, 4, and 1)!
Any help would be appreciated!!!
