taking custody of son back from wife

I am in the process of divorcing my wife. The process has been going on for almost four years. Since 2005 she moved out of our house and has had 4 different addresses. I have raised our two boys since 2005. In June this year she recently moved back from Oklahoma and in July i let my youngest son visit her for two weeks. I have always let her visit or talk to the boys. The day before i was to pick him up she called me up and said she was going to keep him. We have no formal custody orders in place, so i was told she had every right to do this. She now refuses to let me contact him by phone or to visit him. She lives 300 miles from my house and i only way i have been able to see him is one hour at lunch at his school she has enrolled him in. Because she has delayed our court hearings, she had had him now for two months. Now my question is this - since we do not have any court orders what would be the down side of my picking him up from school and taking him back home.
Oh and just so you know, my son has requested that i take him home on the five visits i have made to his school. And claims to never have wanted to live with him mom and wants to live with me. He tells me he is not allowed to discuss me or coming home. My son is 10 years old.
