Property taxes and interest on house.

Hello, To be honest, I do not where to post this. My divorce was final on Aug 1. Until then, my ex paid for the mortgage. I have now taken on the mortgage as of Sept 1. I do get the equity in the sale of the house, since we took out $35,000 of the equity in the house to help build his business. The equity was mostly there before we got married. I will now get $20,000 at most--with %6 to %7 going to the realtor.
We live in Nebraska. When he abandoned us (myself and a special needs toddler), I was not working. I am now employed. My question is if I can claim the entire amount of the interest and property taxes for 2007 as I still live here. We both have great credit but I had a realtor come in and I need about $1000 to $1500 worth of work done to the house to get it sellable. It is a 1996. Broken things like dishwasher needs to be cut out from under wooden floor to replace, broken doors, broken toilets, roto rooting, trash compactor, His office needs to be re-painted. The list goes on.
There is nothing in the decree that says he gets to claim the taxes and interest. Both names are on the house. It was mine to begin with. His business bloomed and he makes over $130,000 a year now compared to my $25,000. I could really use a decent tax return to pay for the fixtures. He will not help me. Basically my problem.
Okay, I will tackle it but then I need to be able to right off as many items as possible. Are there any tax lawyers out there who could give me insight. I want to move so I can get my daughter into a better special needs school district.
I know a lot of men out there are angry at women like me, but I did not leave him--he left us and he left me to care for our beautiful girl. He does a great job paying his child support and I get a very small alimony check but not enough to cover all this. He takes her for his visits but is not pro active in her life and seems in denial of her Down Syndrome. She is precious.
Men, please don't yell at me. There are some wonderful women out there too. We are victims of situations, just like you. Every situation is different.
Thnaks in advance for any insight.
