divorced only 1/2 the year, how do I file?? Also ?

HI, I have only been divorced since Aug 1st. Do I have to file with my ex or can we file seperately? We have 3 kids together, I am CP. We each get a child to claim each year and the third child is shared depending if an even or odd year. I am wondering since we have only been divorced under 6 months if we should file together if that can be done or should do seperately. He makes more than me and I have very low income this year and not sure if claiming my one this year will make a difference, it is in the papers that if it doesn't benefit me I must let him use that child. Also if he does claim seperately with the 2 this year and possibly the third if it doesn't benefit me, can I still claim EIC for the 3 since I should get it since my income is low. or does none of this even matter since we have been divorced under a year?

This tax stuff is very confusing when it comes to splitting the kids between the two of us. AND to boot he has since quit his job and is no longer making child support payments, but they won't recognize this yet as it just happened and he fulfilled up until dec of 07.

Also does anyone know how the CP can go about moving out of town? the NCP moved about 6 weeks ago across state line about 80-90 miles away. he still comes to get kids for his wknd visits but forfiets his weekly arranged visits as he never shows. In the papers it doesn't say whether we need permission or anything even relating to moving. Will I need to go to court for this?
