Pension splitting

I am a government worker who has a pension now equal to 75% of my FAS. My wife is a NYS teacher who has a pension that is 3 months shy of being free of the early retirement penalty. She left ten days ago and says that if I don't settle for $100,000 now(roughly 7% of the difference in FAS btw us if you use 60 and 75%) she will take me to court which she claims with the penalty would leave a difference of 28% or 14% to pay her. Has anyone had any experience in NY court with this. Would a planned departure to create this disparity be considered or is straight by the numbers? Please help!
