From what I understand, if a Judge commits acts of gross negligence in their courtroom, then they can be held responsible for some actions. But, I agree, not likely in this scenario. But again, Judges like to keep their jobs and bad press can certainly hinder that ability.
I also agree, a restraining order is a useless instrument with a psychopath. The few situations I can think of though it can help. Such as keeping a mild encounter from escalating, and reducing the willingness of others to help the person to commit these acts. A friend's less likely to help his buddy go 'get something' from the ex's house if he knows there's a restraining order in place.
I also agree whole heartedly that restraining orders should be based upon real evidence, but as we know, even that can be fabricated.
Lastly, I also agree strongly that a restraining order should always be both ways. I've seen this abused many times and can't understand why such a simple matter in law can't be fixed. One old friend of mine going through a divorce was accused of child and domestic abuse by his ex. Restraining order issued and his ex would go out of her way to find him just so she could call the cops and have him arrested. This even included her following him to church.
My ex is under a 'terms of release' from her child abuse conviction and still violates the no contact order. That, in and of itself, doesn't bother me so much as she's not a threat over the phone. What galls me is that her attorney tries to turn it around and claim that I'm calling and harassing her. But I'm just venting now...
