Commingling & Transmutation - Inheritance

I'm getting a divorce in TN. STBX rec'vd inheritance in 2006, placed all the funds into our joint money market bank account were it remained. He & I both used it as we felt like it. Later during the year of 2006, he used about 68K of the inheritance out of the joint money market account and paid off the remainder of the home mortgage. The mortgage was a joint marital debt, in my name & the Xs name. The deed to the home is my name & the Xs name as well. Now we are at the stage of splitting the equity in the home for the MDA. He wants to be reimbursed for the inheritance. My attorney says that he commingled the funds & created trasmutation by paying the joint debt and that I am entitled to my portion of the home equity. Does anyone know if the TN court will see this in my favor?
