Hi All,
I got served with papers that I had been expecting.
I'm not happy with the grounds that my wife's lawyer chose for her, but have been told and have read that grounds in NY have little if any impact on the outcome.
I had fully expected ADULTERY, since I've been with someone since I left 3 years ago. instead, the grounds stated are "cruel and inhumane treatment making it unsafe or inapropriate for the defendent to cohabitate".
First.....should I get a lawyer? I have to pay HERS so I was just waiting to see if her demands were fair. No point in making TWO attorneys wealthy, and my being in debt for years.
Also, now that I have the papers in hand, what do I do? There is no place for me to sign and return to her attorney, so what exactly is the next step? Do I HAVE to appear in court?
One more question.....I gross about an even $100K/yr. can anyone with experience tell me about how much maintenence I can expect to pay? We have no assets, no cash, and little debt, since our house is now in foreclosure.
My wife and I are still very close and talk freely. She says that she's been told that she's entitled to about 48%.....can this be true :shocked:?! I want to take care of her, but not to the point where I'm eating rice cakes and she's feasting on caviar!
