Is there a problem buying a house prior to divorce

My husband and I (of 26 years) are preparing our house to sell. Do we need to sell this prior to being divorced? Also I would like to find and buy a house before the divorce is final so that we can move out. I am wondering if somehow this new house of mine could be considered his house too if we are not yet divorced when I buy it. How would this work?

We do not have much equity in the house, if any, now with the market prices as they are and an equity loan as a second mortgage. Any help about anything will be appreciated, I have never done this before. Thank you!
