"because I am also paying for my daughters college tuition and medical bills since he is not obligated to contribute because she is over 18. I believe the best thing for me to do is take a hardship withdrawl from my 401K to make my mortgage current but to be able to do that forclusure notices have to be sent."
You're losing your house, but are paying your dd's college and medical expenses? Take care of yourself first. Dd can get a job or two or three to get her self through college. Yeah, it'd be nice, but she can borrow for college, you can't borrow for retirement. What good will it do dd to have HER bills paid while you've lost your house and retirement over it... do you think this is what SHE wants?? And to cash out your 401k... and do what exactly, when you're too old or unhealthy to work? Is your retirement plan to live with dd?
If there isn't enough money for all the bills, here are the ones you NEED to pay... food, shelter, clothing, and transportation. You need these to live. Anything else is not a must... if you have extra money, by all means, but if it's not there, it's not there. And with you, it seems it's not there.
